Below you will find the Privacy Policy of BCP Belgium VZW // Rue Général Tombeurstraat 71 // 1040 Brussels (hereafter called BCP). We/we’ and ‘us’ refer to BCP; We are the custodian of the personal data that we collect, as set out in this privacy policy. Our website, https://bcpbelgium.be, is owned and operated by us.

At BCP, we are aware that you place your trust in us and our services. We therefore see it as our responsibility to protect your privacy. In our privacy policy we would like to inform you about what information we collect from you when you use our website, the purpose for which we collect it and how we can improve your user experience. This will give you a transparent view of how we work.

We will only use your personal data in accordance with the GDPR and other relevant legal regulations in force. Every reference in this Privacy Policy to the GDPR means a reference to the Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data.

(c) You may use our website’s contact form to ask a specific question about our services or our website, or about the opportunities we offer you to work with us. In that case, we will use your personal information to respond to your request.

3. What personal data we collect

The following categories for personal data can be distinguished:

Contact details (provided directly by you):

  • Name

  • Email address

  • Telephone number

  • Postal address

These personal data will be processed for the purposes set out in clause 2(a), (b), (c), (f) and (g).

Contact details (provided by a third party):

We may receive your personal information via a third party we have contracted to obtain your personal information. In such cases we will receive and process the following personal data: your name, telephone number, email address, address we have requested. These personal data are processed for the purposes set out in article 2(b) and/or 2(x). Before we use personal data that we have not received directly from you, we will provide you with this privacy policy as soon as possible and ask your consent to the use of your personal data.

Usage Data:

We may collect personal data about your activities on our website through Google Analytics and cookies: IP address, device ID and type, referral source, language settings, browser type, operating system, geographic location, length of visit, page views, or information about the timing, frequency and pattern of your use of our services. This information may be processed for the purposes set out in article 2(d) and 2(e).

Briefing Data (provided directly by you):

When you complete the online briefing form on our website, we collect and process the following data:

·       Identification and contact details (e.g., name, company, job title, email address, telephone number);

·       Project-related information that you voluntarily provide in the briefing form, which may include details about your business, project objectives, timelines, budgets, and other relevant content.

These data are processed for the purposes set out in clause 2(j).

4. Legal basis

BCP relies on the following legal bases for the processing of personal data, depending on the purpose of the processing;  

(a) Performance of a contract Your personal data may be processed where it is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into a contract. This includes, but is not limited to, processing your order, billing purpose, carrying out correspondence with you, providing you with a subscription. 

(b) Compliance with a legal obligation Certain personal data may be processed where required to comply with legal obligations to which BCP is subject. This may include obligations relating to fraud prevention, financial reporting, or other statutory requirements. 

(c) Consent In specific cases, we will seek your consent before processing your personal data. This is notably the case where we send you newsletters or marketing communications by email or by post, or where we use cookies to collect data about your browsing behaviour. Where consent is required, you may withdraw it at any time using the mechanisms provided in Clause 7. 

(d) Legitimate interest We may process personal data where it is necessary for the purposes of the legitimate interests pursued by BCP, provided that such interests are not overridden by your interests or fundamental rights and freedoms. This includes processing for internal business operations, improvement of services and user experience, personalisation of content and analysis of website usage. 

5. Storage period and disposal

We will retain your personal data for as long as your account is active or to the extent necessary to provide you with our services.

5.1 However, as it is not possible for us to specify such a period in advance, the retention period will be determined as follows:

(a) After termination of the contract the data will be stored for 5 years on a local and secure server at BCP. We will retain and use your registration information to the extent necessary to comply with our legal obligations and to resolve disputes.

(b) Personal data used by us for direct marketing will be stored, retained and used for as long as we believe you will benefit from our communications.

(c) Personal information provided to us via the contact form will be stored, retained and used for as long as necessary to respond to your request.

(d) Usage data will be stored and retained for as long as such data is useful for the support of the website.

5.2. Should you withdraw your consent or object to our use of your personal data, we will erase your personal data from our databases. Please note that we retain minimal personal data to ensure that your preferences are respected in the future and only to ensure that you do not receive any further communications from us.

7. Rights of the person concerned

7.1. This article sets out your main rights under the GDPR. We have tried to summarise them in a clear and legible way.

We will respond to your request within one month of receipt of the request. Should an extension of the deadline for responding to your request be necessary, we will inform you accordingly.

7.3. The right of access

You have the right to receive confirmation from us as to whether or not we are processing your personal data. Should this be the case, you have the right to access such personal data, together with any additional information also set out in this privacy policy.

You have the right to receive from us a copy of any personal data held by us, provided that this does not adversely affect the rights and freedoms of others. The first copy will be provided free of charge but we reserve the right to charge a reasonable fee where requests are manifestly unfounded or excessive.

7.4. Right of rectification

If the personal data in our possession are inaccurate or incomplete, you have the right to rectify or supplement this information, taking into account the purposes of processing.

7.5. The right to have data erased

In certain circumstances, you have the right to delete your personal data. These are the following circumstances:

(a) The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

(b) You withdraw your consent and there is no other legal basis;

(c) The processing is for the purpose of direct marketing;

(d) The personal data has been unlawfully processed; or

(c) we no longer need the personal data for the processing, but you require personal data for the purpose of recording, exercising or defending legal claims; or

(d) you have objected to the processing, pending verification of that objection.

We will inform you before lifting the limitation on data processing and will also provide you with the reasons for which the restriction is being lifted

7.7. The right to data portability

However, this right does not apply where this would adversely affect the rights and freedoms of others.

7.8. The right to object to processing

You have the right to object to the processing of your personal data on the basis of your specific situation, but only to the extent that the legal basis for processing is that the processing is necessary for the purpose:

7.9. The right to lodge a complaint with a supervisory authority

8. International data transfer

8.1. We will ensure that a transfer of data to countries outside the European Economic Area is carried out with appropriate security measures. As we use Google Services, your personal data may be transferred outside the European Economic Area.

8.2. If your data must be stored on servers located in the United States of America, the transfer will rely on the EU–US Data Privacy Framework, which has been approved by an adequacy decision of the European Commission. This ensures an equivalent level of protection for your personal data. .

9. The disclosure of your personal data to others

9.1. In order to provide you with our services and to maintain a database containing your contact details, we work with a third party service provider to process and store your personal data. We work with the following service providers:

(a) databases/hosting: Combell

(b) cloud platform: Google Inc.

9.2. If you are a customer of ours, we may disclose your personal data to the suppliers we have contracted or intend to contract in order to provide our services to you. If you are a supplier to us, we may disclose your personal information to our customers to introduce you as a potential supplier, or in the course of providing the services.

9.3. We may also disclose your personal data in the event that this is necessary to comply with a legal obligation. We may also disclose personal information to protect your vital interests or the vital interests of another natural person.

9.4. As such, we do not disclose personal data to our social media partners. However, we do use social media plug-ins to direct you to our social media channels and give you the opportunity to use our content. These social media channels are Facebook, Instagram, LinkedIn, Twitter, Google+, Vimeo, Youtube and Pinterest. When you share an item via Twitter, LinkedIn or Google+, like an item using ‘Like’ on Facebook, watch a video embedded in our website via Vimeo, or click on a link to our profile on a social media channel, such a social media service provider may collect personal information about you and link that information to your existing profile on such channel. In such event, the social media service provider will act as an controller.
